Cette crise a \u00e9t\u00e9 caus\u00e9e principalement par le march\u00e9 immobilier, ce qui \u00e9tait \u00e9vident en raison du grand nombre de d\u00e9fauts de paiement hypoth\u00e9caire qui ont \u00e9t\u00e9 d\u00e9tect\u00e9s au cours de la m\u00eame p\u00e9riode. Pour cette raison, y compris certains autres facteurs, l&rsquo;ancienne <strong>loi hypoth\u00e9caire espagnole<\/strong> est devenue une question controvers\u00e9e. C&rsquo;est pourquoi un <strong>changement de la l\u00e9gislation hypoth\u00e9caire en Espagne<\/strong> a \u00e9t\u00e9 mis en \u0153uvre. L\u2019objectif de cette modification l\u00e9gale \u00e9tait de r\u00e9duire le nombre important de conflits, ce qui impliquait une r\u00e9vision de la relation entre pr\u00eateurs et emprunteurs, c\u2019est-\u00e0-dire entre les banques et leurs clients. Dans l&rsquo;article suivant, nous d\u00e9veloppons donc les faits essentiels de la <strong>nouvelle loi hypoth\u00e9caire espagnole de 2019<\/strong>. Veuillez en prendre note !<\/p>\n<h2>Le changement de la loi hypoth\u00e9caire espagnole<\/h2>\n<p>Premi\u00e8rement, nous vous pr\u00e9sentons un nouveau r\u00e8glement qui r\u00e9gira l\u2019ensemble du domaine des pr\u00eats hypoth\u00e9caires. Il couvre ce qu&rsquo;on appelle la loi sur le cr\u00e9dit immobilier. Vous la verrez \u00e9galement r\u00e9f\u00e9renc\u00e9e comme la loi 5\/2019 du 15 mars, bien qu\u2019elle soit entr\u00e9e en vigueur le 16 juin 2019. Sa promulgation implique une modification visant \u00e0 harmoniser les lignes directrices relatives aux pr\u00eats hypoth\u00e9caires.<\/p>\n<p>Alors, qu&rsquo;est-ce qui est inclus dans cette nouvelle loi sur les hypoth\u00e8ques espagnol ? D\u2019une mani\u00e8re g\u00e9n\u00e9rale, la nouvelle l\u00e9gislation renforce la s\u00e9curit\u00e9 juridique des clients dans leurs relations avec les banques. Ce qui suit explique de quelle mani\u00e8re ces lignes directrices dans la pratique hypoth\u00e9caire, se concr\u00e9tiseront :<\/p>\n<ul>\n<li><strong>Les co\u00fbts li\u00e9s aux pr\u00eats hypoth\u00e9caires vont maintenant \u00eatre r\u00e9partis diff\u00e9remment<\/strong>. Il y a toujours eu une certaine controverse quant \u00e0 savoir qui devait les payer (en g\u00e9n\u00e9ral, c&rsquo;\u00e9tait les clients qui devaient les payer), de sorte qu\u2019avec la nouvelle loi, il est beaucoup plus clair de savoir qui paie quoi, et les co\u00fbts sont maintenant r\u00e9partis comme suit : la \u00ab gestoria \u00bb , le registre, le notaire et l\u2019AJD (taxe hypoth\u00e9caire) sont pay\u00e9s par la banque, tandis que les frais d\u2019\u00e9valuation et d\u2019ouverture \/ arrangement sont \u00e0 la charge du client.<\/li>\n<li><strong>La protection des consommateurs sera renforc\u00e9e<\/strong>, par exemple via l\u2019obligation pour la banque de fournir des informations claires et concises, adapt\u00e9es au niveau de compr\u00e9hension du client.<\/li>\n<li><strong>Les fautes professionnelles commises par les banques pour ces produits financiers seront pers\u00e9cut\u00e9es<\/strong>, comme l\u2019introduction de clauses contractuelles abusives.<\/li>\n<li><strong>Une nouvelle entit\u00e9 ind\u00e9pendante sera cr\u00e9\u00e9e<\/strong>, qui sera charg\u00e9e de la r\u00e9solution des litiges relatifs aux plaintes relatives en mati\u00e8re hypoth\u00e9caire.<\/li>\n<li><strong>Le remboursement anticip\u00e9 d&rsquo;une hypoth\u00e8que co\u00fbtera moins cher<\/strong> et ne pourra \u00eatre factur\u00e9 par les entit\u00e9s bancaires que s&rsquo;il est prouv\u00e9 que les contrats de pr\u00eat hypoth\u00e9caire leur causent des pertes.<\/li>\n<li>Au d\u00e9triment des hypoth\u00e8ques \u00e0 taux variable (que le consommateur moyen trouve souvent plus difficile \u00e0 comprendre), <strong>les clients sont encourag\u00e9s \u00e0 contracter des hypoth\u00e8ques \u00e0 taux fixe<\/strong>, ce qui leur procure davantage de s\u00e9curit\u00e9, sachant d\u00e8s le d\u00e9part le co\u00fbt total de l&rsquo;hypoth\u00e8que pour lequel ils ont appliqu\u00e9.<\/li>\n<li><strong>Vous pourrez modifier votre hypoth\u00e8que plus facilement<\/strong> car, lorsque vous regardez votre hypoth\u00e8que, vous ne serez pas oblig\u00e9 d&rsquo;accepter l&rsquo;offre \u00e9quivalente de la banque aupr\u00e8s de laquelle vous avez contract\u00e9 votre emprunt actuel, ce qui se produisait souvent dans le pass\u00e9.<\/li>\n<li><strong>Les clauses d&rsquo;\u00e9ch\u00e9ance pr\u00e9coce et de reprise de possession ne peuvent \u00eatre appliqu\u00e9es que lorsque douze paiements mensuels impay\u00e9s sont accumul\u00e9s<\/strong>.<\/li>\n<li><strong>La vente des produits attach\u00e9s \u00e9tant limit\u00e9e<\/strong>, les clients ne sont plus oblig\u00e9s de contracter pour obtenir l&rsquo;hypoth\u00e8que, bien que les produits combin\u00e9s puissent toujours \u00eatre vendus tant que les banques leur offrent des options alternatives \u00e0 titre de comparaison.<\/li>\n<li><strong>Les clauses plancher ont \u00e9t\u00e9 supprim\u00e9es<\/strong> des hypoth\u00e8ques \u00e0 taux variable.<\/li>\n<li><strong>Vous pourrez convertir, si vous le souhaitez, des pr\u00eats hypoth\u00e9caires multidevises en euros<\/strong>.<\/li>\n<li><strong>Les activit\u00e9s des interm\u00e9diaires financiers seront davantage contr\u00f4l\u00e9es<\/strong>, ce qui favorisera une plus grande transparence des contrats que les clients signeront dans le cadre de leur m\u00e9diation.<\/li>\n<\/ul>\n<p>En bref, la loi actuelle sur les hypoth\u00e8ques corrige les d\u00e9fauts de la pr\u00e9c\u00e9dente, principalement en faveur du consommateur, qui, nous sommes s\u00fbrs que vous, en tant qu&rsquo;acheteur potentiel, sera heureux de savoir, et se conforme maintenant mieux aux conditions du march\u00e9 des pr\u00eats associ\u00e9s \u00e0 la propri\u00e9t\u00e9 actuelle en Espagne.[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section][et_pb_section fb_built=\u00a0\u00bb1&Prime; This crisis was primarily caused by the real estate market, and this was evident due to the large amount of mortgage payment defaults that were detected during the same period. For this reason, including some other factors, the old <strong>Spanish mortgage law<\/strong> became a controversial matter, therefore, a <strong>change of mortgage law in Spain<\/strong> was put in motion. The objective of this legal modification was to reduce the significant number of conflicts, which involved a revision of the relationship between moneylenders and borrowers i.e. between the banks and their clients. In the following article, we therefore elaborate on the <strong>key facts of the new Spanish mortgage law in 2019<\/strong>, so if you are applying for a mortgage to purchase your Spanish property or will need one at some point, then please take note!<\/p><h2>The Change in Spanish Mortgage Law<\/h2><p>Firstly, we introduce to you a new regulation that is going to govern the whole area of mortgage loans. It is covers what is known as the <strong>real estate credit law<\/strong>. You will also see it referenced as the <strong>5\/2019 Act<\/strong>, of the 15th march, although it actually came into vigour on the 16th June 2019. Its enactment involves, an amendment in terms of its harmonisation to the guidelines relating to mortgage lending.<\/p><p>So what is included in this new mortgage law? In general, the new legislation increases the legal security for clients in their dealings with banks. The following explains in which way these guidelines in mortgage practice, will come to fruition:<\/p><ul><li><strong>Mortgage related costs are now going to be distributed in a different way<\/strong>.
